Depending on how you interact with us, we may collect the following categories of personal data:

  • Contact details: first name, last name, email address, phone number, billing address, shipping address, postcode, city, and country.
  • Account information: username, password (stored in encrypted form), account preferences, and settings.
  • Transaction data: order details, items purchased, returns, exchanges, payment confirmations, and order history. Card details are processed directly by our payment providers and are never stored by us.
  • Communications: messages, emails, and support requests you send to us.
  • Website and device data: IP address, browser type and version, device identifiers, operating system, referring URL, and interaction data.
  • Cookies and analytics data: as described in Section 11 below.
  • Marketing preferences: newsletter subscription status and consent records.

We do not knowingly collect special category data (such as health, ethnicity, or political opinions) and ask that you do not send such information to us.

3. How We Collect Your Data

We collect personal data:

  • Directly from you — when you create an account, place an order, contact customer support, subscribe to our newsletter, leave a review, or otherwise communicate with us.
  • Automatically — through cookies, analytics tools, and similar technologies when you use our website.
  • From third parties — including our payment processors, shipping carriers, fraud-prevention services, and Shopify (our e-commerce platform).

Where we rely on consent, you may withdraw it at any time without affecting the lawfulness of processing carried out before withdrawal.

5. Purposes of Processing

We use your personal data to:

  • Process and deliver your orders, including returns, exchanges, and refunds;
  • Manage payments via third-party providers;
  • Provide customer support and respond to enquiries;
  • Create and maintain your account;
  • Send transactional communications (order confirmations, shipping notifications, etc.);
  • Send marketing communications where you have given consent;
  • Detect, prevent, and investigate fraud, abuse, and security incidents;
  • Comply with legal, accounting, tax, and regulatory obligations;
  • Analyse and improve our website, products, and services;
  • Personalise your shopping experience and show relevant advertisements (with consent where required).

We do not engage in automated decision-making that produces legal or similarly significant effects about you within the meaning of GDPR Article 22.

6. Data Sharing and Recipients

We share personal data only with parties necessary to run our business and deliver our services. All recipients are bound by data protection agreements and act only on our instructions (except where they are independent controllers, noted below).

Shopify — our e-commerce platform provider, which hosts our store and processes data on our behalf. Shopify may also act as an independent controller for certain enhanced features. Payment processors (card data goes directly to them — we never see or store it):

Other service providers — IT and hosting providers, email/newsletter platforms, customer support tools, analytics providers, and fraud-prevention services.

Legal and regulatory authorities — where required by law, court order, or to protect our legal rights.

Business transfers — in the event of a merger, acquisition, restructuring, or sale of assets, your data may be transferred to the successor entity.

We do not sell your personal data.

7. International Data Transfers

Some of our service providers (including Shopify) are based outside the European Economic Area (EEA) and the UK. When we transfer your data outside the EEA or UK, we rely on one of the following safeguards:

  • An adequacy decision by the European Commission or the UK government;
  • The European Commission's Standard Contractual Clauses (SCCs) or the UK's International Data Transfer Agreement (IDTA) / UK Addendum;
  • Supplementary technical and organisational measures where required.

8. Data Retention

We retain personal data only for as long as necessary for the purposes described in this Policy, or to comply with legal obligations. Retention periods vary by country and data type:

  • Order, invoice, and accounting records — retained for the period required by applicable bookkeeping and tax law:

    Denmark: 5 years (Bogføringsloven)

  • Account data — kept while your account is active; deleted or anonymised on request or after a reasonable period of inactivity.
  • Marketing data — until you withdraw consent or unsubscribe.
  • Analytics data — maximum 14 months, then anonymised or deleted.
  • Customer support communications — up to 3 years after resolution.
  • Fraud / security logs — up to 2 years.

After these periods, data is securely deleted or anonymised.

9. Your Rights

Under the EU GDPR, UK GDPR, and equivalent national laws, you have the following rights:

  • Right of access — obtain a copy of the personal data we hold about you.
  • Right to rectification — correct inaccurate or incomplete data.
  • Right to erasure ("right to be forgotten") — request deletion where permitted.
  • Right to restrict processing — in certain circumstances.
  • Right to object — to processing based on legitimate interests or direct marketing.
  • Right to data portability — receive your data in a structured, machine-readable format and transmit it to another controller.
  • Right to withdraw consent — at any time, where processing is based on consent.
  • Right not to be subject to automated decisions — with legal or similarly significant effects (we do not carry out such processing).
  • Right to lodge a complaint — with your national data protection authority (see below).

If you believe we have not handled your data properly, you have the right to complain to the supervisory authority in your country of residence:

10. Children's Privacy

Our website and services are intended for adult customers. We do not knowingly collect personal data from children below the digital consent age applicable in your country:

12. Data Security

We use appropriate technical and organisational measures to protect your personal data, including:

  • TLS / HTTPS encryption for all data transmission;
  • Access controls and authentication;
  • Regular security reviews, updates, and patching;
  • Staff training on data protection;
  • Vetting of sub-processors and contractual safeguards.

No security measure is perfect. In the event of a personal data breach likely to result in a risk to your rights and freedoms, we will notify the competent supervisory authority within 72 hours and, where required, notify affected individuals without undue delay.

13. Marketing Communications

Marketing emails and newsletters are sent only with your explicit consent. You can withdraw consent at any time by:

Withdrawing marketing consent does not affect transactional communications (such as order confirmations) which we must send as part of our contract with you.

At Småkryp AB ("we", "our", "us"), we are committed to conducting business in a responsible, ethical, and sustainable manner. We expect the same standards from every supplier, contractor, manufacturer, and business partner that provides goods or services to us.

This Supplier Code of Conduct ("Code") sets out the minimum standards we require across our supply chain in the markets we serve: the United Kingdom, Germany, Denmark, Norway, Finland, Sweden, and the Netherlands. It reflects our commitment to international human rights, labour standards, environmental responsibility, product safety, and business ethics.

Compliance with this Code is a precondition of doing business with Småkryp AB. We view our relationships with suppliers as long-term partnerships built on transparency, dialogue, and continuous improvement.

1. Purpose and Commitment

Småkryp AB is committed to sourcing products that are made under ethical, socially responsible, and environmentally sound conditions. As a toy retailer, we recognise our particular responsibility to children — both those who play with our products and those who might otherwise be exposed to exploitation in global supply chains.

We expect all suppliers to comply with this Code and to make every reasonable effort to implement these principles within their own operations and throughout their supply chains.

This Code is built on the principles of transparency, dialogue, and continuous cooperation between Småkryp AB and its suppliers.

2. Scope and Applicability

This Code applies to:

  • All suppliers, manufacturers, contractors, agents, and business partners providing goods or services to Småkryp AB;
  • All subcontractors and sub-suppliers engaged by our suppliers; and
  • All workers employed by these parties in connection with goods or services supplied to us.

Suppliers are responsible for ensuring that equivalent standards are upheld throughout their entire supply chain, including any facilities and subcontractors used to produce goods sold to Småkryp AB.

3. International Standards and Legal Framework

All goods and services supplied to Småkryp AB must be produced in accordance with the following international standards, conventions, and frameworks:

Suppliers must also comply with all applicable local, national, and international laws and regulations in every country where they operate, and with relevant legislation in the markets we serve, including:

Where the requirements of this Code differ from applicable law, the stricter standard applies.

4. Human Rights and Due Diligence

Suppliers shall support and respect internationally recognised human rights and must not contribute, directly or indirectly, to human rights violations.

Suppliers are expected to carry out human rights due diligence in line with the UN Guiding Principles and the OECD Guidelines, including:

  • Identifying and assessing actual and potential human rights risks in their own operations and supply chain;
  • Taking appropriate action to prevent, mitigate, and remediate adverse impacts;
  • Tracking the effectiveness of those actions;
  • Communicating how impacts are addressed;
  • Providing for, or cooperating in, legitimate remediation where harm has occurred.

Suppliers operating in or supplying goods to Germany, Norway, or the Netherlands must ensure their processes also meet the due diligence obligations under the LkSG, the Åpenhetsloven, and the Dutch Child Labour Due Diligence Act respectively.

5. Labour Standards

5.1 Child Labour (ILO 138, ILO 182; UN CRC Art. 32)

Child labour is strictly prohibited.

  • No worker shall be under 15 years of age (or 14 where permitted by ILO 138), or below the legal minimum working age, whichever is higher.
  • Young workers (15–18) may only perform non-hazardous work, must have completed compulsory education, and must be protected from work that interferes with schooling or is harmful to their health, safety, or development.
  • If child labour is identified, suppliers must act in the best interests of the child — including removing the child from the workplace, supporting their return to education, providing appropriate remediation, and notifying Småkryp AB without delay.

5.2 Forced Labour (ILO 29, ILO 105)

All forms of forced, bonded, indentured, trafficked, or involuntary prison labour are strictly prohibited.

  • Employment must be voluntary, and workers must be free to leave with reasonable notice.
  • Workers must not be required to lodge deposits, identity papers, or original documents with the employer.
  • Recruitment fees and related costs must be paid by the employer, not the worker (ILO "Employer Pays Principle").
  • Debt bondage, withholding of wages, and physical or psychological restriction of movement are prohibited.

5.3 Non-Discrimination and Harassment (ILO 100, ILO 111)

Suppliers shall promote equal opportunities and fair treatment for all workers.

  • Discrimination on the basis of gender, gender identity, sexual orientation, ethnicity, nationality, religion or belief, disability, age, marital or family status, political opinion, pregnancy, union membership, or any other protected characteristic is prohibited.
  • Harassment, bullying, and physical, psychological, verbal, or sexual abuse are strictly prohibited.
  • Suppliers shall provide accessible mechanisms for workers to raise discrimination or harassment concerns without retaliation.

5.4 Freedom of Association and Collective Bargaining (ILO 87, ILO 98)

Suppliers shall respect workers' rights to:

  • Form and join trade unions of their own choosing;
  • Engage in collective bargaining;
  • Elect worker representatives freely.

Where these rights are restricted by local law, suppliers must provide alternative, parallel means for workers to communicate with management and raise concerns without fear of reprisal.

6. Wages, Working Hours, and Benefits

  • Wages must be paid on time, in full, and directly to the worker.
  • Wages must meet or exceed the legal minimum and collectively bargained wages where applicable, and should aim to meet a living wage sufficient to cover basic needs and provide discretionary income.
  • Wage deductions as a disciplinary measure are prohibited.
  • Workers must receive clear, written information about their wages, hours, and deductions in a language they understand.
  • Overtime must be voluntary, reasonable, and compensated at a premium rate in accordance with local law.
  • Working hours must comply with legal limits and, except in exceptional circumstances, must not exceed 60 hours per week including overtime.
  • Workers must receive at least one day off in every seven-day period.
  • All statutory leave (annual, public holiday, sick, parental, bereavement) must be provided in line with applicable law.

7. Occupational Health and Safety (ILO 155, ILO 170)

Suppliers must provide a safe, healthy, and hygienic working environment for all workers.

This includes:

  • Identifying, assessing, and minimising workplace risks;
  • Providing appropriate training (e.g. fire safety, first aid, hazardous substances, machinery, manual handling);
  • Supplying necessary personal protective equipment (PPE) at no cost to workers;
  • Ensuring clear safety instructions and accessible information in languages workers understand;
  • Providing clean drinking water, adequate sanitation, and hygienic eating areas;
  • Maintaining safe conditions in any worker dormitories provided.

Emergency preparedness must include:

  • Clearly marked and unobstructed emergency exits;
  • Functional fire detection and suppression systems;
  • Regular evacuation drills;
  • Accessible first aid equipment and trained first aiders.

Workers must have the right to remove themselves from imminent danger without fear of retaliation.

8. Product Safety and Quality

As a toy retailer, Småkryp AB places particular importance on product safety. Suppliers of toys and children's products must comply with all applicable product safety legislation in the markets we serve, including but not limited to:

  • EU Toy Safety Directive 2009/48/EC and successor regulations, including the forthcoming EU Toy Safety Regulation;
  • EN 71 series — European standards on the safety of toys (mechanical, flammability, chemical, electrical, etc.);
  • REACH Regulation (EC) 1907/2006 and restrictions on substances of very high concern (SVHCs);
  • EU General Product Safety Regulation (GPSR) 2023/988;
  • UK Product Safety regulations, including the Toys (Safety) Regulations 2011;
  • Applicable national product safety authorities' requirements (e.g. Sweden's Konsumentverket, Germany's BAuA, the Netherlands' NVWA, Norway's DSB).

Suppliers must:

  • Ensure products are CE-marked (and UKCA-marked where required) and accompanied by correct technical documentation, Declarations of Conformity, and age/warning labels;
  • Provide full and accurate product composition, including materials, coatings, adhesives, and any substances of concern;
  • Conduct appropriate testing by accredited laboratories and retain records;
  • Notify Småkryp AB immediately of any safety defect, non-conformity, recall, or regulatory action affecting products supplied to us;
  • Cooperate fully in any recall or corrective action.

9. Responsible Sourcing and Materials

Suppliers must source raw materials responsibly and transparently.

  • Conflict minerals — suppliers using tin, tantalum, tungsten, or gold (3TG) must comply with the EU Conflict Minerals Regulation (EU) 2017/821 and implement due diligence aligned with the OECD Due Diligence Guidance for Responsible Supply Chains of Minerals.
  • Wood and paper — materials should be sourced from responsibly managed forests, ideally certified by FSC or PEFC.
  • Textiles and natural materials (wool, feathers, down, leather) — suppliers must ensure ethical sourcing and, where applicable, certification such as OEKO-TEX, GOTS, or Responsible Down Standard.
  • Animal welfare — no product may involve cruelty to animals. Testing on animals is prohibited where not required by law.
  • Plastics and chemicals — suppliers must work to reduce, substitute, or eliminate hazardous substances and support the transition to recycled and recyclable materials.

10. Environmental Responsibility

Suppliers shall operate in an environmentally responsible manner and comply with applicable environmental legislation.

Suppliers are expected to:

  • Identify, monitor, and reduce their environmental impact (energy use, water use, emissions, effluents, waste);
  • Reduce resource consumption and waste generation;
  • Promote recycling and the efficient use of materials and packaging;
  • Apply a life-cycle perspective to products and services;
  • Manage and dispose of chemicals and hazardous waste in accordance with law;
  • Work towards reducing greenhouse gas emissions consistent with the goals of the Paris Agreement;
  • Set environmental requirements for their own subcontractors.

Continuous improvement of environmental performance is expected, and suppliers are encouraged to adopt recognised environmental management systems such as ISO 14001.

11. Anti-Corruption and Business Ethics

Suppliers must conduct business with integrity and transparency.

  • Bribery, corruption, kickbacks, and improper advantages are strictly prohibited in all forms, whether direct or indirect, and whether involving public officials or private parties.
  • Suppliers must not offer, request, or accept any undue financial or other benefit.
  • Facilitation payments are prohibited.
  • Gifts and hospitality must be modest, infrequent, and never given to influence business decisions.
  • Conflicts of interest — suppliers must disclose any actual or potential conflict of interest involving Småkryp AB employees or their relatives.
  • Fair competition — suppliers must comply with applicable competition and antitrust law and must not engage in price-fixing, bid-rigging, or market allocation.
  • Accurate records — suppliers must keep complete, accurate financial records and must not engage in money laundering or tax evasion.

Suppliers must comply with applicable anti-bribery legislation, including the UK Bribery Act 2010, the UN Convention Against Corruption, and equivalent national laws in the countries where they operate.

12. Trade Compliance and Sanctions

Suppliers must comply with all applicable export controls, customs, and international sanctions laws, including those administered by the European Union, the United Kingdom, the United Nations, and the United States (where applicable).

Suppliers must not source from, supply to, or otherwise transact with any sanctioned party, government, or territory in violation of applicable restrictions.

13. Data Protection and Confidentiality

Suppliers must protect any personal data and confidential information they receive from, or on behalf of, Småkryp AB.

  • Personal data must be processed in accordance with the EU GDPR, the UK GDPR, and applicable national data protection laws.
  • Suppliers processing personal data on behalf of Småkryp AB must enter into a written Data Processing Agreement in accordance with GDPR Article 28.
  • Appropriate technical and organisational security measures must be in place.
  • Personal data breaches affecting Småkryp AB data must be notified to us without undue delay and in any event within 24 hours of discovery.

Suppliers must also maintain confidentiality of commercial and technical information received from Småkryp AB and use it only for the purposes for which it was shared.

14. Grievance Mechanism and Whistleblowing

Suppliers must establish, or participate in, an effective grievance mechanism that allows workers and affected stakeholders to raise concerns — anonymously where desired — without fear of retaliation.

Mechanisms should be:

  • Accessible — known to workers and available in languages they understand;
  • Legitimate, predictable, and equitable — operated fairly and transparently;
  • Rights-compatible — aligned with internationally recognised human rights; and
  • A source of continuous learning — used to identify and address systemic issues.

Suppliers operating within the EU must comply with the EU Whistleblowing Directive 2019/1937 as transposed in the relevant member state, and in the UK with the Public Interest Disclosure Act 1998.

Reporting to Småkryp AB: anyone — workers, community members, business partners — may report concerns about potential breaches of this Code directly to us at Madde@smakryp.se. Reports will be handled confidentially, and retaliation against those who raise concerns in good faith is strictly prohibited.

15. Implementation, Monitoring, and Compliance

Suppliers are responsible for implementing this Code within their operations and throughout their supply chains. Compliance is supported through:

  • Transparency and cooperation — open sharing of information about suppliers, subcontractors, production locations, and working conditions;
  • Ongoing dialogue — constructive engagement on issues identified;
  • Monitoring and follow-up — including self-assessments, audits (announced and unannounced), and site visits;
  • Training — ensuring management and workers are aware of the Code and their rights.

Småkryp AB reserves the right to request documentation, conduct audits (directly or through third parties), and verify compliance at any time.

Non-compliance. If a breach is identified, suppliers are expected to implement corrective actions within a reasonable and agreed timeframe, in proportion to the severity of the issue. We prefer a collaborative approach focused on remediation and improvement.

Serious or repeated breaches — or refusal to remediate — may result in suspension or termination of the business relationship.

  • Are actively expanding the share of our range that meets the requirements of Giftfri Förskola (the Swedish "Poison-Free Preschool" initiative) — a voluntary standard that goes beyond legal minimums to reduce children's exposure to harmful substances.

Through careful material assessments and review of test documentation, we ensure an increasing share of our products meets these stricter chemical safety criteria, and we work towards aligning our entire product range with them over time.

Documentation on request. Hospitals, dental clinics, and other professional buyers can request Declarations of Conformity, test reports, and material safety summaries for any product in our range.

7. Hygiene, Infection Control, and Allergens

Many of our customers operate in environments where hygiene and infection control are critical. We take this into account in how we select, pack, and document our products.

Hygiene and cleanability. Where relevant, we provide information on whether products are:

  • Wipeable / cleanable with standard disinfectants used in clinical environments;
  • Single-use (for settings where reuse is not appropriate);
  • Individually wrapped, which many clinics require for hygiene reasons;
  • Suitable for cleaning in accordance with national infection control guidance.

Latex. A significant proportion of children, and many healthcare workers, have latex allergies. We clearly identify products that contain natural rubber latex and maintain a growing range of latex-free alternatives for medical and dental customers.

Allergens. We do not sell products intended for consumption. However, for items that resemble or mimic food (e.g. scratch-and-sniff toys, play food), we disclose any known allergen content (e.g. nuts, gluten, dairy derivatives in scented components).

Age appropriateness in mixed-age settings. Hospital and clinic waiting rooms serve children of all ages. We help professional buyers select ranges that are suitable for mixed age groups and clearly flag products with small parts, choking hazards, or other age-restricted features.

  • We contact affected customers directly — particularly important for our professional customers, who may have distributed the product to many children;

13. Procurement, Invoicing, and Compliance for Professional Buyers

  • Proper VAT handling — reverse charge for intra-EU B2B sales with valid VAT numbers, UK VAT handling post-Brexit, local VAT where applicable;
  • E-invoicing / PEPPOL — we can issue electronic invoices through PEPPOL for public sector customers in countries where this is mandatory (Sweden, Denmark, Norway, Finland, and increasingly Germany and the Netherlands);

  • Payment terms — standard and negotiated terms for qualified customers.

Procurement compliance. For public sector buyers subject to EU Public Procurement Directive 2014/24/EU (and equivalent UK rules), we can provide:

In the event of a product-related incident, our liability is governed by the EU Product Liability Directive (and the incoming revised Product Liability Directive (EU) 2024/2853) and the equivalent national law in the country where the product is placed on the market.

This policy and the operations of Småkryp AB are governed by the laws of Sweden.

We comply with all applicable European Union, EEA, and United Kingdom legislation and regulatory requirements in the markets we serve. Where national requirements are stricter than EU minimums (as is often the case in Germany, the Netherlands, and the Nordic countries for chemical safety and consumer protection), we apply the stricter standard.

These Terms of Sale govern the purchase of products from Småkryp AB ("Småkryp", "we", "us", "our") through our website and through direct B2B orders. They apply to customers in the United Kingdom, Germany, Denmark, Norway, Finland, Sweden, and the Netherlands.

We sell to both private consumers (B2C) and business customers (B2B). Some terms differ depending on which category you fall into — these are clearly marked. Where a term is not marked, it applies to both.

By placing an order with us, you confirm that you have read, understood, and agree to these Terms of Sale.

2. Scope and Applicability

These Terms of Sale apply to all purchases from Småkryp AB, unless a separate written agreement has been signed between Småkryp and a business customer (in which case the written agreement prevails).

Our Website Terms of Use, Privacy Policy, and Cookie Policy also apply and are incorporated by reference.

3. Orders and Contract Formation

Products displayed on our website are an invitation to treat and do not constitute a binding offer. An order becomes a binding contract only when we send you an order confirmation by email.

If you place an order in error, please contact us immediately at Support@smakryp.se. We will do our best to cancel or amend it before dispatch, but cannot guarantee this.

We may refuse or cancel an order, for example in cases of:

  • Incorrect pricing or obvious technical errors on our website;
  • Suspected misuse, fraud, or breach of these Terms;
  • Outstanding unpaid invoices;
  • Failure to pass our credit assessment (for B2B invoice orders);
  • Products being unavailable despite stock indications.

If a product is unavailable despite being listed as in stock, we will inform you. Where possible, the product may be placed on backorder. You have the right to cancel a backordered order at any time before dispatch.

4. Prices, Currency, and VAT

All prices are shown in the currency selected on our website — typically Swedish kronor (SEK), euros (EUR), or pounds sterling (GBP) — depending on your location.

VAT handling:

  • Private consumers in the EU — applicable VAT is included in the displayed price in accordance with the country of destination (under the EU One-Stop Shop (OSS) scheme).
  • Private consumers in Sweden — Swedish VAT (currently 25%) applies.
  • Private consumers in the UK — UK VAT is applied where relevant, in accordance with HMRC rules on overseas sellers.
  • Private consumers in Norway — handled via the VOEC (VAT On E-Commerce) scheme.
  • Business customers with a valid EU VAT number outside Sweden — sales are generally made under the reverse-charge mechanism; no Swedish VAT is charged. A valid VAT number must be provided at checkout or when placing the order.
  • Swedish B2B customers — Swedish VAT applies in the normal way.

We reserve the right to adjust prices due to changes in VAT, supplier costs, currency fluctuations, or other circumstances beyond our control. Such adjustments will never affect orders that have already been confirmed.

5. Payment Terms

5.1 Private Consumers (B2C)

Private consumers pay at the time of purchase using the payment methods offered at checkout — typically including major debit and credit cards (Visa, Mastercard, Maestro), Klarna, and local payment methods appropriate to the customer's country.

We do not offer invoice payment to private consumers.

Orders are processed once payment has been successfully authorised. Where Klarna or similar "buy now, pay later" services are offered at checkout, those payments are subject to Klarna's own terms and credit assessment.

5.2 Business Customers (B2B)

Business customers have access to a broader range of payment methods, including:

  • All payment methods offered to private consumers (card, Klarna, local methods);
  • Invoice via Billie — available in several European markets, subject to Billie's own credit assessment and terms;
  • Direct invoicing from Småkryp — available to Swedish business customers only (see Section 5.3).

5.3 Direct Invoicing — Swedish B2B Customers Only

As a service to our Swedish professional customers (hospitals, clinics, dental practices, and other business buyers registered in Sweden), we offer:

  • Direct invoicing from Småkryp AB;
  • 30-day payment terms from the date of invoice (net 30);
  • Dispatch of goods prior to payment, subject to credit assessment and approval.

Conditions:

  • Available only to businesses registered in Sweden with a valid Swedish organisation number;
  • Offered at Småkryp's sole discretion, based on creditworthiness, order history, and internal risk assessment;
  • Småkryp reserves the right to withdraw direct invoicing at any time and to require payment by card, Klarna, or Billie for any order;
  • Retention of title applies to all goods supplied on invoice (see Section 6);
  • First-time customers may be asked to pre-pay their first order before direct invoicing is offered.

Business customers outside Sweden are welcome to apply for invoice payment via Billie, which offers B2B invoice payment across several European markets, subject to Billie's own terms and credit assessment.

5.4 Late Payment

If payment is not received by the due date, we reserve the right to:

  • Charge statutory late-payment interest in accordance with the applicable national law implementing the EU Late Payment Directive 2011/7/EU. This is typically 8 percentage points above the relevant central bank reference rate for B2B transactions;
  • Charge reminder fees and recovery costs in accordance with applicable law (e.g. in Sweden, up to SEK 60 per reminder and SEK 450 in recovery costs under Inkassolagen and Räntelagen);
  • Suspend further deliveries or withdraw credit terms;
  • Refer the debt to a collection agency.

For public sector buyers, payment terms and late-payment interest are handled in accordance with the specific rules for public authorities under the EU Late Payment Directive (maximum 30 days, exceptionally up to 60 days with justification).

6. Retention of Title (B2B)

For all business customers, and in particular for Swedish B2B customers purchasing on invoice under Section 5.3:

  • Ownership of the goods remains with Småkryp AB until the full purchase price (including VAT, interest, and any recovery costs) has been paid in full.
  • Until payment is received, the customer holds the goods in custody on our behalf (Swedish: eigendomsförbehåll; German: Eigentumsvorbehalt; Dutch: eigendomsvoorbehoud).
  • The customer may resell the goods in the ordinary course of business, but must keep them identifiable and insured until paid for.
  • In the event of insolvency, bankruptcy, or a serious breach of payment obligations, Småkryp reserves the right to reclaim the goods.

This clause is enforceable under Swedish law (Lösöreköplagen and Konsumentkreditlagen for the equivalent consumer version) and the laws of the other markets we serve.

7. Delivery and Shipping

7.1 Delivery Times

Standard delivery times vary by destination:

  • Sweden: typically 2–4 business days
  • Denmark, Finland, Norway: typically 3–6 business days
  • Germany, Netherlands: typically 4–7 business days
  • United Kingdom: typically 5–8 business days (subject to customs clearance)

Delivery times are indicative and may be longer during peak periods, holidays, or due to circumstances beyond our control.

7.2 Shipping Costs

Shipping costs are calculated at checkout based on destination, weight, and service level. Free shipping thresholds may apply — these are displayed clearly at checkout.

7.3 Carriers

We ship via a range of carriers depending on destination, including:

  • PostNord (primarily Sweden, Denmark, Norway, Finland)
  • DHL (Germany, Netherlands, UK, and elsewhere)
  • UPS (international and express)
  • Other regional carriers as appropriate

7.4 Customs and Import Duties

For deliveries to the United Kingdom and Norway (outside the EU customs union), import duties and additional charges may apply depending on the order value and the applicable thresholds. We handle VAT via the UK VAT and Norwegian VOEC schemes for qualifying low-value consignments; above those thresholds, customs duties may be charged separately by the carrier or authorities on delivery.

Information on applicable thresholds and charges is provided at checkout where possible.

8. Delivery Delays and Force Majeure

If delivery is delayed, we will inform the customer as soon as reasonably possible.

For consumers: if delivery is significantly delayed and we cannot deliver within a reasonable additional time set by you, you have the right to cancel the order and receive a full refund, in accordance with the EU Consumer Rights Directive and equivalent UK and Norwegian law.

Force majeure. We shall not be liable for delays or failures caused by circumstances beyond our reasonable control, including supplier failure, transport and logistics disruption, labour disputes, natural disasters, pandemics, governmental actions, cyber-attacks, or other events of force majeure. This does not affect the consumer's right to cancel and receive a refund in cases of significant delay.

Lost shipments. In the rare case of a lost shipment, we will arrange a replacement or a full refund.

9. Risk and Transfer of Ownership

For consumers: risk of loss or damage to the goods passes to you when you (or a third party indicated by you, other than the carrier) take physical possession of the goods — in accordance with EU Consumer Rights Directive Article 20 and equivalent UK and Norwegian law.

For business customers: risk passes when the goods are handed over to the carrier, unless otherwise agreed (standard EXW / FCA terms apply). Ownership remains with Småkryp until full payment (see Section 6).

10. Right of Withdrawal (Consumers Only)

This section applies only to consumers — not to business customers.

As a consumer, you have the right to withdraw from a distance purchase within 14 days without giving any reason, under:

10.1 Withdrawal Period

The 14-day period starts from the day on which you, or a third party (other than the carrier) indicated by you, take physical possession of the goods. For orders containing multiple items delivered separately, the period starts when the last item is received.

10.2 How to Exercise the Right

To exercise your right of withdrawal, you must inform us of your decision by a clear statement (e.g. by email) to Support@smakryp.se before the 14-day period expires. You may use the EU model withdrawal form but are not required to.

10.3 Effects of Withdrawal

If you withdraw, we will refund all payments received from you, including standard delivery costs, without undue delay and in any event within 14 days of being informed of your decision.

Refunds are made using the same payment method you used for the original transaction, unless otherwise agreed.

We may withhold the refund until we have received the goods back or you have supplied evidence of having sent them, whichever is earlier.

10.4 Return Conditions

  • You must return the goods without undue delay and in any event within 14 days of informing us of your withdrawal.
  • Goods must be returned in their original condition and packaging, unused, with any labels or seals intact.
  • You are responsible for the cost of returning the goods unless we expressly agreed otherwise.
  • You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature, characteristics, and functioning.
  • Returns sent cash on delivery (COD) will not be accepted.
  • Please contact us before returning any goods to obtain return instructions.

10.5 Exceptions to the Right of Withdrawal

The right of withdrawal does not apply to:

  • Goods made to the consumer's specifications or clearly personalised;
  • Sealed goods that are not suitable for return for reasons of health or hygiene and have been unsealed after delivery;
  • Goods which are, according to their nature, inseparably mixed with other items after delivery.

10.6 Business Customers (B2B)

Business customers do not have a statutory right of withdrawal. Returns by B2B customers are accepted only where expressly agreed by Småkryp in writing, at our discretion.

11. Returns and Refunds

Please contact us before sending any return so we can provide instructions and, where applicable, a return reference.

Refunds are processed once the returned goods have been received and inspected. In accordance with consumer law, consumer refunds are issued within 14 days of our receipt of the returned goods or proof of dispatch, whichever is earlier.

12. Statutory Warranty and Complaints

Consumers are entitled to the full protection of the statutory legal guarantee of conformity under:

  • EU Directive (EU) 2019/771 on the sale of goods — implemented nationally;
  • UK Consumer Rights Act 2015 (Part 1, Chapter 2);
  • Norwegian Forbrukerkjøpsloven (Consumer Purchases Act).

This means that if a product is defective, not as described, or not fit for its intended purpose, you are entitled — at minimum — to:

  1. Repair or replacement of the product, free of charge; or
  2. A proportionate price reduction or a full refund if repair or replacement is not possible or appropriate.

12.1 Complaint Periods

  • Germany, Netherlands, Denmark, Finland: 2 years from delivery.
  • Sweden: 3 years from delivery under Konsumentköplagen.
  • Norway: 2 years from delivery, extended to 5 years for products intended for significantly longer use under Forbrukerkjøpsloven § 27.
  • United Kingdom: 6 years from delivery (5 years in Scotland) to bring a claim under the Consumer Rights Act 2015.

To make a complaint, contact us at Madde@smakryp.se describing the product, order number, and nature of the defect. Please retain proof of purchase. Where possible, photos of the defect help us process complaints quickly.

Complaints must be made within a reasonable time after the defect is discovered, in accordance with applicable law.

12.2 Business Customers (B2B)

For business customers, statutory warranty is governed by the Swedish Sale of Goods Act (Köplagen) or equivalent applicable law. Business customers must inspect goods on receipt and notify Småkryp of any visible defects or shortages within 7 business days of delivery. Hidden defects must be reported within a reasonable time of discovery and no later than 2 years from delivery.

Nothing in this section limits consumer rights.

13. Product Safety Recalls

If a product we have sold is found to present a safety risk, we will act in accordance with our Quality and Product Policy and the EU General Product Safety Regulation (EU) 2023/988:

  • We will stop sales immediately;
  • We will notify affected customers directly using our order records;
  • We will offer a full refund, replacement, or repair, and reimburse reasonable costs (including return postage) where appropriate;
  • We will report the incident through the EU Safety Gate and/or the UK OPSS Product Safety Database as required.

14. Limitation of Liability

To the extent permitted by applicable law, Småkryp AB shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our products or services, including loss of profit, loss of business, or loss of data.

Consumer carve-out. Nothing in these Terms limits or excludes our liability for:

  • Death or personal injury caused by our negligence;
  • Fraud or fraudulent misrepresentation;
  • Defective products under the EU Product Liability Directive (as revised) and equivalent national law;
  • Any other liability that cannot be limited or excluded under mandatory consumer law in your country of residence.

For business customers, our total aggregate liability for any claim arising in connection with the supply of goods is limited to the price paid for the goods in question, except where such limitation is not permitted by law.

15. Data Protection

We process personal data in accordance with our Privacy Policy, the EU GDPR, the UK GDPR, and applicable national data protection laws. Personal data is shared with third parties only where necessary to fulfil your order (e.g. payment providers, shipping carriers) or where required by law.

16. Dispute Resolution

We hope you will never have a reason to complain, but if you do, please contact us first at Support@smakryp.se — we will always try to resolve matters directly and fairly.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of Sweden, without regard to conflict-of-laws principles.

Consumer protection. If you are a consumer resident in the United Kingdom, Germany, Denmark, Norway, Finland, or the Netherlands, the choice of Swedish law does not deprive you of the protection afforded by mandatory consumer protection provisions of the law of your country of habitual residence, in accordance with Regulation (EC) No 593/2008 (Rome I), Article 6.

Jurisdiction. In accordance with Regulation (EU) No 1215/2012 (Brussels I Recast), Articles 17–19:

  • A consumer may bring proceedings against us either in the Swedish courts or in the courts of their own country of domicile;
  • We may only bring proceedings against a consumer in the courts of the consumer's country of domicile.

For business customers, disputes are subject to the exclusive jurisdiction of the Swedish courts, with Kristianstad District Court (Kristianstads tingsrätt) as the court of first instance.

18. Changes to These Terms

We may update these Terms of Sale from time to time. The version in force at the time of your order is the version that applies to that order.

The latest version is always published on our website with a revised "Last updated" date. Material changes affecting existing customers on an ongoing basis (e.g. Swedish B2B invoice customers with open account terms) will be notified by email with reasonable prior notice.

19. Language and Miscellaneous

  • Language — these Terms are provided in English. Translations into other languages are provided for convenience only; in the event of any discrepancy, the English version prevails, except where mandatory local law requires otherwise.
  • Severability — if any provision of these Terms is found to be unlawful or unenforceable, the remaining provisions remain in full force.
  • No waiver — our failure to enforce any right is not a waiver of that right.
  • Assignment — you may not assign your rights under these Terms without our consent. We may assign ours in connection with a merger, acquisition, or transfer of business.

We apply a lifecycle perspective in our decision-making — from material choice and manufacturing, through packaging, transport, and use, to end-of-life.

4. Climate and Carbon

We recognise that climate change is one of the defining challenges of our time, and that every business has a role to play in reducing greenhouse gas emissions.

Our climate commitments:

  • To measure our greenhouse gas emissions across Scope 1 (direct), Scope 2 (purchased energy), and — progressively — Scope 3 (value chain), in accordance with the GHG Protocol;
  • To reduce emissions within our own operations through energy efficiency, renewable electricity, and responsible business travel;
  • To work with suppliers and logistics partners to reduce emissions across our supply chain;
  • To align with the goals of the Paris Agreement — limiting global warming to well below 2 °C, and pursuing efforts to limit it to 1.5 °C;
  • To be transparent with customers, particularly professional buyers subject to their own CSRD reporting, about our carbon footprint where we are able to measure it.

We recognise that, as a small importer and retailer, a significant share of our emissions sits with our suppliers and transport partners. Our approach is therefore as much about influence and partnership as it is about direct action.

5. Materials, Chemicals, and Product Design

We seek to minimise the environmental and health impact of the products we sell.

Materials. We prioritise:

  • Certified wood — sourced from responsibly managed forests, ideally certified by FSC or PEFC;
  • Recycled and recyclable plastics, where quality and safety allow;
  • Textiles from sources such as OEKO-TEX, GOTS, or Responsible Down Standard where applicable;
  • Products compatible with the EUDR where deforestation risk commodities are involved.

Chemicals. We comply with the chemical safety requirements of REACH, the EU Toy Safety Directive (Annex II Part III), and the ECHA Candidate List. We expand the share of our range that meets the stricter requirements of Giftfri Förskola ("Poison-Free Preschool"), which goes beyond legal minimums to reduce children's exposure to harmful substances.

Product design. We work to offer products that are:

  • Durable — designed to last;
  • Repairable or replaceable in part, where practical;
  • Recyclable or safely disposable at end-of-life.

We are preparing for the requirements of the EU Digital Product Passport under the Ecodesign for Sustainable Products Regulation (ESPR) as it is rolled out to the toy sector.

6. Packaging and Extended Producer Responsibility

We minimise packaging to what is necessary to protect the product and the child who will use it.

Our packaging principles:

  • Use recycled and recyclable materials wherever possible;
  • Avoid unnecessary plastic and composite materials that cannot be easily recycled;

We aim to operate as close to a circular model as our size and sector allow:

  • Reusing — cartons, filler materials, and pallets within our operations where safe and appropriate;
  • Recycling — separating waste streams (paper, cardboard, plastic, metal, electronics, hazardous waste) in accordance with local waste management rules;
  • Disposing responsibly — of any hazardous or regulated waste through authorised channels;
  • Measuring and monitoring waste volumes and recycling rates over time.

We apply the waste hierarchy (prevention → reuse → recycling → recovery → disposal) as set out in the EU Waste Framework Directive.

A significant proportion of our environmental footprint comes from the movement of goods — from supplier to warehouse, and from our warehouse to customers across seven countries.

We work to reduce the impact of transport by:

  • Optimising shipments — consolidating orders, filling containers and parcels efficiently, avoiding unnecessary express deliveries where standard shipping meets customer needs;
  • Choosing lower-impact carriers and services where options exist, including carrier-led electric or biofuel delivery fleets in urban areas;
  • Partnering with carriers that have credible climate commitments, including PostNord, DHL, and UPS;
  • Minimising business travel and replacing it with video conferencing where effective;
  • Planning supplier visits efficiently to reduce the emissions per trip.

9. Supplier and Supply Chain Responsibility

Environmental responsibility starts long before a product reaches us. We work closely with our suppliers to ensure environmental considerations are integrated throughout the supply chain.

We:

  • Require suppliers to comply with our Supplier Code of Conduct, including its environmental provisions;
  • Encourage suppliers to adopt recognised environmental management systems such as ISO 14001;
  • Set expectations for responsible material choices and chemical compliance;
  • Support continuous improvement in supplier environmental performance;
  • Conduct regular evaluations, audits, and dialogue to verify progress;
  • Progressively engage with suppliers on climate reporting and reduction, in line with emerging CSRD and CSDDD requirements in Europe.

Where a supplier cannot or will not meet our environmental expectations, we work with them to define a corrective action plan — and, as a last resort, end the relationship.
